Who are we and what is this about?

We are ESG Spotlight from Switzerland and responsible for this website. This is our Data Protection Statement ("DPS"), in which we provide you, as the data subject, with the necessary information so that you can exercise your rights and ensure that data processing is transparent for you.
 
This DPS forms the basis on which we process all personal data that we collect in connection with your use of and interaction with this website or any other online presence we manage, including our social media presences and our applications ("Apps"), collectively referred to as "Website".

This website may contain links to and from the websites of our partner networks, advertisers, and affiliates. Please note that these have their own DPSs, and we cannot be held liable or accountable for them. This DPS is from November 2023. We reserve the right to modify it at any time. What personal data do we process from you, for what purpose,
and with whom do we share it?

When you visit our HubSpot website

When you visit our website, our servers temporarily store each access in a log file. The following technical data is collected, as is generally the case with any connection to a web server, without your intervention and is stored by us until automated deletion:

  • The IP address of the requesting computer
  • The name of the owner of the IP address range (usually your Internet Service Provider)
  • The date and time of access
  • The website from which the access was made (Referrer URL), possibly with the search term used
  • The name and URL of the retrieved file
  • The status code (e.g., error message)
  • The operating system of your computer
  • The browser you use (type, version, and language)
  • The transmission protocol used (e.g., HTTP/1.1)


The collection and processing of these data are for the purpose of enabling the use of our website (connection setup), ensuring the system's security and stability on a permanent basis, enabling the optimization of our internet offer, and for internal statistical purposes.
Data stored in the CRM will remain until the contact record is deleted. Personal data will therefore be stored as long as a legitimate business interest exists.


For this, we are supported by our partners, who themselves are subject to data protection regulations that we have carefully selected and to which we have contractually obligated them to comply with data protection, particularly with regard to data security.

When you contact us via email or phone

If you choose to contact us via email or phone, you consent to us processing your first name, surname, email address, title, possibly organization, phone number, and possibly a suggested appointment time, as well as the content of our conversation for the purpose of communicating with you until we are convinced that you are satisfied, and subsequently archiving or deleting the data in accordance with legal requirements.

When you become our offline customer

Becoming our customer requires that you or your organization enter into a contract with us. For this purpose, we need data such as your name, first name, title, possibly organization, phone number, email address, delivery address, billing address, and payment method. This allows us to check and possibly establish a customer relationship with you or your organization. It also enables us subsequently to provide the services or deliver the goods that you or your organization have requested for the purpose of executing the contract. In addition, we create a file about you or your organization containing your contact details, work performed, transactions, communication, documents created or received, time spent, as well as information for billing and accounting. All this will be retained in accordance with legal requirements.


When you obtain free products from us

We offer various content for free download on our website. To obtain these, we ask you to provide your email address. If you decide to obtain our content, you consent to us processing your name, surname, email address and your interaction with our newsletter to deliver our newsletter tailored to your interests via email, ensure its receipt, and possibly improve our offer based on your interaction. This includes the use for further advertising purposes on social media (e.g., for so-called Lookalike Audience campaigns). When you follow our presence on social media

If you decide to follow our presence on social media and possibly communicate with us through it, you consent to us processing your username for the management and analysis of our followers (including for advertising purposes) and the content of any interaction with us or our content. You can leave our presence at any time, effective for the future.
For the operation of such a presence, we are jointly responsible with the operator of the respective platform: we are responsible for processing your data as described above, and the platform operator is responsible for processing your data according to the participation agreement between you and the platform operator.

Do we disclose your personal data abroad?

We work with various partners at home and abroad (see above). Generally, these are located in countries that demonstrate an appropriate level of data protection. Should the disclosure to individual countries require additional protection, we ensure this by agreeing upon data protection standard contractual clauses approved by the authorities with such partners or by relying on the self-certification of such partners under the corresponding agreements.

 

What are your rights regarding us?

You have the right to:

  • Request information from us about your personal data, as well as its correction or deletion.
  • Ask us to restrict the processing of your personal data, especially to object to the processing of your personal data for marketing purposes.
  • Demand that we provide you or a natural or legal person you appoint with a digital file of your personal data (data portability).

You may revoke your consent to the processing of your personal data for the stated purposes at any time with effect for the future.
You also have the right to file a complaint with the competent authority (Federal Data Protection and Information Commissioner).
